Opportunity to Provide Input

In August 2010, Plumas Sierra Rural Electric Cooperative's (PSREC's) Telecommunications Division received an American Recovery and Reinvestment Act (ARRA) Grant Award to provide fiberoptic cable to their service territory and surrounding areas in rural northeastern California and northwestern Nevada. The portion of the project on the Plumas National Forest would allow for service to extend from Portola to Quincy. On the Plumas National Forest (PNF), approximately 13 miles of existing overhead pole structures would have one-inch diameter fiber conduit attached in the existing powerline Right of Way (ROW). The Plumas National Forest proposes to issue PSREC a 50-year Special Use Permit to access, install, maintain and operate associated telecommunication services on the Plumas National Forest. No additional facilities are anticipated to be on PNF-administered lands, including no staging areas. The existing pole infrastructure would be accessed from associated ROWs or easements. Hanging the fiberoptic lines would be finished in approximately 20 months.

The preliminary assessment is that this proposal falls within a category of actions listed in the Forest Service NEPA Handbook (FSH) that are excluded from documentation in an Environmental Assessment (EA) or Environmental Impact Statement (EIS) and there are no extraordinary circumstances that would preclude use of the category. (36 CFR220.6(e)(2) Additional construction or reconstruction of existing telephone or utility lines in a designated corridor).

DECISION NOTICE AND FINDING OF NO SIGNIFICANT IMPACT

PETERS ROAD PROJECT

BECKWOURTH, CALIFORNIA

DECISION

Based on my review of the potential effects of the Peters Road Project presented in the Peters Road Project Environmental Assessment and comments submitted by the public and interested organizations, I have decided to approve the construction of the Peters Road Project. My decision includes the mitigation and minimization measures identified in the Environmental Assessment to avoid potentially significant effects to wildlife, plants, hydrology, soils, and cultural resources (Environmental Assessment pp. 7-9).

The USDA Forest Service will construct approximately 2,780 feet of access road through the Plumas National Forest from Forest Road 25N11H north/northwest to a private parcel (APN 008-280-002). The road will be constructed along the alignment of a logging skid road that had been previously used for timber harvest and was then subsoiled. The new access road will be constructed with native materials and will be 12 feet wide with 3-foot shoulders. No trees will be removed for the road construction and overall ground disturbance will be approximately 1 acre. The project is located in Plumas County, California and is approximately four miles north of Frenchman Lake in Township 25N, Range 16E, Sections 19 and 30.

Reasons for My Decision

I have decided to build the Peters Road Project as proposed in the Environmental Assessment since there were no concerns expressed by the public or other agencies and the effects from the project would be minimal. This project will meet the need to provide access to private parcel APN 008-280-002, which is bound on all sides by National Forest System lands and currently has no access. Construction of the new access road will not significantly affect natural resources.

ALTERNATIVES CONSIDERED IN DETAIL, BUT NOT SELECTED

Alternative 2 (No-action)

Under the No Action Alternative, no access road would be built through National Forest lands to the Peters' private parcel. Thus, no changes would occur to the existing environment in the project area.

PUBLIC INVOLVEMENT

The Beckwourth Ranger District started the NEPA scoping process with publication of a public scoping notice in the Portola Reporter on September 29, 2010. A total of 9 Proposed Action description packets (Proposed Action and figure) were sent to various individuals, organizations, government agencies, and tribes. The scoping period ended on November 30, 2010. The purpose of the scoping process was to inform the public about the Proposed Action, Purpose and Need in order to seek different points of view on the pending action and issues to be addressed during the project analysis period.

Following the scoping period, the Peters Road Project Environmental Assessment was prepared based on the findings of specialist studies that addressed potential impacts to wildlife, plants, soils, hydrology, and cultural resources. A legal notice was published in the Portola Reporter on January 19, 2011 to inform interested parties that the project's Environmental Assessment was available for review and comment. The 30-day comment period ended February 18, 2011.

FINDING OF NO SIGNIFICANT IMPACT

The significance of environmental impacts must be considered in terms of context and intensity. This means that the significance of an action must be analyzed in several contexts such as society as a whole (human and national), the affected region, the affected interests, and the locality. Significance varies with the setting of the proposed action. In the case of a site-specific action, significance usually depends upon the effects in the locale rather that in the world as a whole. Intensity refers to the severity or degree of impact (40 CFR 1508.27).

CONTEXT

The environmental effects of the project are confined to the project area and vicinity. The scale of impacts depends on the resource analyzed as outlined in the Environmental Assessment.

INTENSITY

The intensity of effects was considered in terms of the following:

1. Impacts may be both beneficial and adverse. A significant effect may exist even if the Federal agency believes that, on balance, the effect will be beneficial. Consideration of the intensity of environmental effects is not biased by beneficial effects of the action.

2. The degree to which the proposed action affects public health or safety. There will be no significant effects on public health or safety. All proposed activities meet requirements of the Clean Air Act and the Clean Water Act. Best Management Practices for road construction from the Water Quality Handbook are outlined in the Hydrology and Soil section of the Environmental Assessment (pp. 7-8).

3. Unique characteristics of the geographic area, such as proximity to historic or cultural resources, park lands, prime farmlands, wetlands, wild and scenic rivers, or ecologically critical areas. There will be no significant effects on unique characteristics of the area because the project will be constructed along the alignment of an old logging skid road. The project does not convert farmland and will have no effect to cultural resources. The project includes mitigation to protect cultural resources if they are discovered during construction activities (Environmental Assessment p. 9).

4. The degree to which the effects on the quality of the human environment are likely to be highly controversial. There is no known potential controversy over the impacts of the proposed project. Road construction will follow Forest Service standards and will implement appropriate Best Management Practices (Environmental Assessment pp. 7-8).

5. The degree to which the possible effects on the human environmental are highly uncertain or involve unique or unknown risks. The project's effects are not uncertain and do not involve unique or unknown risk. The project is similar to other road building projects on the forest and follow established Forest Service guidelines and standards.

6. The degree to which the action may establish a precedent for future actions with significant effects, or represents a decision in principle about a future consideration. The action will not establish a precedent for future actions with significant effects because it is a routine action with no significant impacts.

7. Whether the action is related to other action with individually insignificant but cumulatively significant impacts. The cumulative effects are not significant and are limited to the local area with no other effects expected to be additive to the proposed action. Potential future projects in the local area that may contribute to cumulative impacts include road closures from the Plumas National Forest Travel Management Plan and the upstream Meadowview-Rowland Wetland Restoration Project. However, these projects would have beneficial impacts to water quality and natural resources and would not contribute to any negative cumulative impacts.

8. The degree to which the action may adversely affect districts, sites, highways, structures, or objects listed or eligible for listing in the National Register of Historic Places or may cause loss or destruction of significant scientific, cultural, or historical resources. The action will have no significant adverse effect on districts, sites, highways, structures, or objects listed or eligible for listing in the National Register of Historic Places. The action will also not cause loss or destruction of significant scientific, cultural, or historical resources (Environmental Assessment p. 9). If project ground disturbance should expose a cultural deposit, the disturbance will stop until an archaeologist can evaluate the material. In the event that human remains are discovered during project activity, existing law requires that project managers contact the county coroner. If the remains are determined to be of Native American origin, both the Native American Heritage Commission and any identified descendants shall be notified (Environmental Assessment pp. 8-9)

9. The degree to which the action may adversely affect an endangered or threatened species or its habitat that has been determined to be critical under the Endangered Species Act of 1973. The action will not adversely affect any endangered or threatened wildlife or plant species or habitat that has been determined to be critical under the Endangered Species Act of 1973 because (1) there is no known habitat for any threatened or endangered species, (2) there have been no observations of any threatened or endangered species in or near the project area, and/or (3) the project area is above the elevation range of threatened or endangered species (Environmental Assessment pp. 6-7).

10. Whether the action threatens to violate Federal, State, or local law or requirements imposed for the protection of the environment. The action will not violate Federal, State, or local laws or requirements for the protection of the environment (Environmental Assessment pp. 9-12).

After considering the effects of the actions analyzed, in terms of context and intensity, I have determined that these actions will not have a significant effect on the quality of the human environment. Therefore, an Environmental Impact Statement (EIS) will not be prepared.

FINDINGS REQUIRED BY OTHER LAWS AND REGULATIONS

In addition to the FONSI, I find that this project is consistent with the Land and Resource Management Plan for the Plumas National Forest (1988) as amended by the HFQLG Act and FEIS/FSEIS ROD and the 2004 SNFPA ROD. Therefore, this project is consistent with the requirements of the National Forest Management Act of 1976. In addition, the Peters Road Project complies with the Endangered Species Act, and the Clean Water Act (Environmental Assessment p. 10), and other federal, state and local laws or requirements imposed for the protection of the environment. Alternative 1 complies with Forest Plan direction and the 2004 SNFPA ROD (Environmental Assessment p. 3).

ADMINISTRATIVE REVIEW OR APPEAL OPPPORTUNITIES

The 30-day comment period ended on February 18, 2011. Since no comments expressing concerns were received during the comment period, this decision is not subject to appeal (36 CFR 215.12). Implementation may begin immediately.

IMPLEMENTATION DATE

No comments were filed during the 215-day comment period, implementation of the decision may occur on, but not before, 5 business days from the close of the appeal filing period.
