Trial of Quincy woman against CHP set to begin

Opening statements are scheduled to begin at 8:30 Wednesday morning, June 13, in a civil trial pitting a Quincy woman against the California Highway Patrol.

The jury trial is taking place at Plumas County Superior Court in Quincy.

Ruth Jackson’s lawsuit stems from her Sept. 12, 2009, arrest and jailing by the CHP on charges of driving under the influence.

Jackson’s civil complaint against the CHP stated she had a blood alcohol level of 0.00 and had no drugs in her system at the time of her arrest.

The jury selection process took place on Tuesday. Visiting Judge Thomas E. Warriner read instructions to the 10-woman, three-man jury before dismissing them about 2:30 p.m.

The trial is expected to last into early next week.

Jackson’s lawsuit names CHP Officers Lacey Heitman, Jim Wheaton and former Quincy Area Commander Paul Davis as defendants.

The civil complaint listed seven causes of action: “false arrest; false imprisonment; battery; intentional infliction of emotional distress; negligent hiring, training and supervision of officers; negligent infliction of emotional distress; and unlawful search and seizure.”

In the complaint, Jackson said she was pulled over after she exited an Oktoberfest event at the Blairsden Barn, where she was working as a volunteer.

The complaint indicated Jackson drove 150 feet to a stop sign and turned left onto Highway 70, before being pulled over less than half a mile later.

The brief said Jackson was told she failed to make a complete stop at the intersection, which she stated was not the case.

The narrative stated that the officers noticed bottles of alcohol in the trunk of Jackson’s car when she opened it to get her driver’s license out of her purse.

According to Jackson’s complaint, the officers ignored her explanations that she was volunteering at the event and was bringing the bottles home to be recycled.

The brief stated that a portable breathalyzer registered Jackson’s blood alcohol level at 0.00.

Jackson said she told the officers she hadn’t taken a prescription drug in more than 12 hours and had never used narcotics.

The complaint alleged the officers didn’t take into account that Jackson had had 12 foot surgeries when she had trouble with “fine balancing” during the field sobriety tests.

According to the narrative, Jackson was arrested at 10 p.m. and was never contacted by a certified drug recognition expert at any point during her encounter with the CHP.

The complaint stated that after Jackson was taken to the CHP office in Quincy, her request to call her husband, local attorney Michael Jackson, was denied.

The court document stated that Jackson was transported in handcuffs to the Plumas County Jail for blood testing, which detected no drugs.

According to the narrative, the test results arrived after Jackson spent a night in jail.

The complaint said that two days after the arrest, an unidentified CHP officer read a police blotter over the local radio station, identifying Jackson by her name, age and residence and asserting that she had been arrested for driving under the influence of Oxycontin.

After the radio broadcast, a press release by Jackson’s daughter – who is also her attorney – Julia Jackson stated the radio report was “especially shocking because they named a specific drug, one widely associated with abuse, when no drug testing had been initiated and no drugs had been found in Mrs. Jackson’s car or on her person.”

The report indicated the district attorney declined to prosecute the case after receiving the evidence.

Anyone that has lived in Plumas County in the past 25 years knows just how corrupt the sheriffs and CHP is there. I dropped a lawsuit years ago when I was told I would never rest again in Plumas County if I went through with it. I have regretted it since. Its time for some officers to be unemployed!

Go get them Ruth!!! The only thing better than seing Ruth win this lawsuit, would be the CHP Officer arrested for Felony DUI. Make them write a big fat check with a public apology on the front page of the newspaper and continually mentioned on the radio for a month.

When I lived in Plumas County 15 years ago, it was my understanding that any sheriff involved in an alcohol related arrest, was on automatic double or even triple time?! This included any court time too. I'am all for getting our roads safe, but this was incentive for officers to push past any laws.

There was an article in the Wall Street Journal on the problems with the Plumas County CHP. The CHP gets paid overtime for the time they appear in court - so look at the books. A prior CHP officer had 30+ years and never pulled a gun - a younger recruit is said to pulled a gun twice within 12 months

That comment should never have been made over the local radio, especially since it proved to be not true at all. Ruth deserves a public apology.

There are people who would fail a field sobriety test due to health issues and the CHP should take that into account in a traffic stop.

Teachers are being laid off, but no CHP's and I see as many as 6 CHP's cruising one stretch of highway in gas guzzling cars. Always twice as many as could be reasonably needed. Never had a ticket, so this isn't sour grapes. Why isn't the budget pain being shared by the CHP?

Completely agree with Robert. CHPs on average make around 100K per year after overtime + retire at 53 with a $7700/month pension (calpers.ca.gov/.../...). All of this with no college education (6 months in an academy). We need to be cutting here, not teachers + schools!

People take jobs because of benefits/pay, including cops. So why complain about the life choices made by others? If you make less or more than someone else it is because of your choices, not theirs. Read the article about the CHP drug arrest. Make up your mind who we want in our county?

Joe- ths woman was obviously singled out by the CHP and harassed, they did not follow proticol at all! I hope they get waht they deserve! But I doubt much will happen. I wonder how many times they (CHP) wanted to settle out of court to avoid the embarassment?

Unfortunately, none of us are privy to the whole story. We certainly can't count on the newspaper for the facts. So any conclusions such as "they did not follow protocol at all" is simply stated with no merit. Unless of course you know what the CHP protocols are and no exactly what happened.

My suggestion would be to hold all individuals accountable ie pay for the trial with all the benefits retirement packages 401 k of the patroll people involved. Set a precedent that has some teeth remove the involved employees from service after the trial.

If the prevailing sentiment among the jurors is similar to what is being expressed here, there is no hope for a fair trial. We most likely do not have all the facts. Think about it, people! Do not be so quick to judge.

Joe I don't care what citizen's make. I care what public servants make because they use a collective bargining union. If this was a person in the private sector they would be fired and stand alone againist the civial lawsuit. Not the CHP, they will use tax dollars to defend.

Noteworthy is that it takes a person with attorneys in the family to even proceed. Without this advangtage most of us would be unable to prosecute. This is what you get when we are forced under the thumb of "big government" of the style of the Obama administration. Democrats equals control over us.
